What terms and conditions usually include

Terms and conditions (also called terms of service or terms of use) form an agreement between you and the people who use your site. A practical set of terms explains:

  • Who can use the service, including a minimum age.
  • Account rules, if users can sign up.
  • Acceptable use: what users must not do.
  • User content: who owns it and what license you need to display it.
  • Payments, subscriptions and refunds, if you sell anything.
  • Intellectual property: your content, logo and code belong to you.
  • Disclaimers and limitation of liability, within what the law allows.
  • Termination, governing law and how you will announce changes.

Tips before you publish

  • Keep the terms consistent with your privacy policy and refund policy. If they contradict each other, users and courts may read the contradiction against you.
  • Check the governing law clause. Consumers in many countries keep the protection of their local law whatever your terms say.
  • If you run a marketplace, handle sensitive data, offer financial or health services or have high-value contracts, generic terms are rarely enough. Get a lawyer to draft or review them.
  • Show the terms at sign-up and checkout, and keep a record of which version each user accepted.

Frequently asked questions

Are terms and conditions required by law? +

Usually there is no general law that says every website must have terms and conditions. But they are the main way to set rules for using your service, limit your liability where the law allows it and explain how payments and subscriptions work. If you sell to consumers, many countries do require you to give certain information before purchase.

What is the difference between terms and conditions and a privacy policy? +

Terms and conditions are the rules users agree to when they use your service. A privacy policy explains how you handle their personal data. Most sites that collect data or sell something need both.

Can I limit my liability completely? +

No. Many countries do not allow businesses to exclude liability for certain things, such as negligence causing injury, or to remove consumer rights. That is why the template says the limits apply only "to the fullest extent permitted by law". A lawyer can tell you what is enforceable where you operate.

How do users agree to my terms? +

Agreement is stronger when users take a clear action, such as ticking a box or clicking a button that says they accept the terms, with a link to them. A link in the footer alone gives weaker evidence of agreement.
